1. Acceptance and Scope

Nodeflame does not undertake and shall not make any payment for any damages, compensation, penalties, costs, or similar amounts.

This provision shall not apply where mandatory consumer protection or other applicable laws require otherwise. In such cases, it shall apply only to the extent permitted by applicable law.

13. Indemnification

You agree to indemnify and hold Nodeflame harmless from and against any claims, damages, costs, and expenses arising from or related to your violation of these Terms.

14. Force Majeure

Our obligations may be suspended or the applicable performance periods may be extended due to events beyond our reasonable control, including natural disasters, war, strikes, infrastructure or power failures, cyberattacks, regulatory actions, and similar events.

15. Termination

Nodeflame may suspend or terminate your access to the Site in the event of a violation of these Terms or where required for security or other legitimate reasons.

Sections 7, 11–13, 16, and 17 shall survive termination.

16. Governing Law and Jurisdiction

These Terms shall be governed by the laws of Estonia.

The courts of Tallinn, Estonia, shall have exclusive jurisdiction over any disputes arising out of or in connection with these Terms.

Mandatory jurisdiction rules under applicable consumer protection laws are reserved and shall continue to apply where required.

17. Entire Agreement and Waiver

These Terms constitute the entire agreement between the parties regarding the use of the Site.

Failure to exercise any right shall not constitute a waiver of that right.

If any provision of these Terms is found to be invalid or unenforceable, the validity and enforceability of the remaining provisions shall not be affected.
